Resin Miniature Commission Agreement

D&K Custom Prints LLC (“Artist”) provides custom resin miniature painting services and painted-finish add-ons. By placing an order and checking the box at checkout, the customer (“Client”) agrees to the terms below.

1) Scope of Work

Each commission is a handmade work of art. Minor variations in color, texture, and finish are normal for resin and paint. Unless otherwise stated, bases, scenic elements, and accessories are finished at the Artist’s discretion to complement the piece.

2) Lead Time

Typical completion time is 4–8 weeks from payment and receipt of all details. Timelines are estimates, not guarantees. Quality will not be rushed.

3) Client Instructions

  • If the Client provides color schemes or references, our Artist will follow them in good faith and exercise creative judgment as needed.
  • If no instructions are provided, the Artist will select a palette and style fitting the model’s theme.
  • Requests to change instructions after work begins may be declined or quoted as a paid change order.

4) Approvals

Before shipping, the Artist will send final photos for approval. If no response is received within 48 hours, the piece is deemed approved and will be shipped as shown.

5) No Cancellations / No Refunds

All commissions and painted-finish add-ons are custom-made. Accordingly, no cancellations, refunds, or returns are accepted once work begins. Chargebacks are prohibited for approved or shipped commissions.

6) Revisions & Touch-Ups

Commissions do not include post-completion revisions or touch-ups. Any requested changes before shipping are discretionary and may incur additional fees.

7) Packing, Shipping & Risk of Loss

  • Items are packed with protective materials and shipped via the selected carrier.
  • Risk of loss transfers to the Client when the carrier accepts the package.
  • If damage occurs in transit, the Client must file a claim with the carrier. If repair is possible, the Artist can assist; shipping both ways and repair costs are the Client’s responsibility.

8) Safety & Care

  • Resin models are collectible display pieces, not toys. Choking hazard—keep away from children and pets.
  • Avoid heat, direct sunlight, and moisture. Handle with care; dropping may cause chips or breakage.

9) Intellectual Property for Custom Requests

The Client represents they have the right to request any logos, insignias, or themed designs supplied to the Artist. The Client will hold the Artist harmless from third-party IP claims related to Client-provided materials. The Artist retains copyright in photographs and videos of the work.

10) Media, Photos & Streaming

The Client grants the Artist permission to photograph, record, stream, and display the project for portfolio, educational, and promotional purposes (SFW only). This does not grant the Client commercial rights to reproduce those images.

11) Payment & Taxes

  • Payment is due at checkout. Sales tax and shipping are calculated per order based on destination and applicable law.
  • Unpaid balances or refused deliveries may result in order cancellation without refund of labor already performed.

12) Abandoned / Unclaimed Work

If the Client fails to provide required approvals, shipping details, or payment for shipping within 30 days after notification, the commission may be treated as abandoned and the Artist may resell or dispose of the item without further liability.

13) Warranties & Limits

The work is provided “as is” consistent with a handmade art commission. To the maximum extent permitted by law, the Artist disclaims implied warranties and limits liability to the amount paid for the specific commission.

14) Force Majeure

The Artist is not liable for delays or nonperformance due to events beyond reasonable control (e.g., carrier interruptions, illness, supply issues, natural disasters).

15) Governing Law

This Agreement is governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Venue and jurisdiction are proper in courts located in Missouri.

16) Acceptance

By checking the box at checkout and completing payment, the Client affirms they have read, understood, and agree to this Agreement. Electronic acceptance is the legal equivalent of a handwritten signature.
